Brian Daniel Mounce’s practice focuses on complex litigation, including various suits dealing with the government. He has represented individuals under federal investigation as well as defended clients at trial and on appeal.
Brian has successfully tried multiple cases across Tennessee in both federal and state court. He has handled numerous cases at the United States Court of Appeals for the Sixth Circuit as well. Prior to joining Burch, Porter & Johnson, Brian served as an Assistant Federal Defender, where he honed his advocacy skills in federal courts against the Department of Justice. He also served as an Assistant Solicitor General and Strategic Litigation Counsel in the Office of the Tennessee Attorney General, representing Tennessee in complex suits against the federal government, and at a boutique civil rights firm in Nashville.
Brian frequently lectures on constitutional theory, history and American political philosophy at various universities. He has also published several articles analyzing constitutional and criminal law. Brian earned his law degree with honors from Tulane and an MSc with honors from the London School of Economics.

Represent individuals in 1983 civil rights matters, mainly unconstitutional arrests, and take appointed cases from the Middle District of Tennessee on criminal matters.
Assistant Solicitor General & Strategic Litigation Counsel (2024)
Represented Tennessee in all stages of litigation including penning motions and appeals. Written appellate briefs in the Sixth, Tenth and Eighth Circuits. Reviewed and edited appellate briefs in most circuits as well as for the United States Supreme Court.
Assistant Federal Public Defender (2022- 2024)
Represented defendants throughout the cycle of criminal cases and proceedings; pre-indictment and through the appellate process. Appeared predominantly in the Sixth Circuit and the Western District of Tennessee. However, worked with criminal defense attorneys in the Fifth and Seventh Circuits on Bruen and discussions regarding Rahimi and the Federal Defenders’ approach to Second Amendment jurisprudence. General duties included trials, appeals, suppression motions, proffers, and sentencing.

Litigation attorney at a large firm in Memphis. Independently handled discovery items, penned motions, defended and took depositions. Practice involved commercial litigation, white collar issues, and luxury estate disputes.
